Act 150- In-Home Care for People with Physical Disabilities

The Act 150 Program is for people with physical disabilities who need help with activities of daily living. The program covers Personal Assistance Services (PAS), Personal Emergency Response Systems (PERS), and Service Coordination. People in Act 150 are Nursing Facility Clinical Eligible (NFCE) but their income and/or resources are too high for the Community HealthChoices (CHC) waiver. 

 

To be eligible for the Act 150 Program, you must be:

1) A resident of Pennsylvania

2) Determined nursing facility clinically eligible (NFCE) based on an assessment; 

3) Between the ages of eighteen (18) and fifty-nine (59) years

4) Capable of all of the following: i) hiring, firing, and supervising attendant care worker(s); ii) managing your own financial affairs; iii) managing your own legal affairs; and iv) directing your own care

5) Diagnosed with a physical impairment expected to last 12 months or more

6) Determined financially ineligible for Medicaid

Application process:

1. Verify eligibility

   1. Age 18-59

   2. Condition: must have chronic, irreversible physical disability lasting 12+ months that restricts activity

   3. Capacity: must be mentally alert and able to hire, fire, and supervise attendants and manage financial legal affairs

   4. Financial: must be ineligible for medicaid (Act 150 is designed for those over income limits)

   5. Need: must require assistance with activities daily living (ADL’s) bathing, dressing, etc

2. Submit application

   1. Contact the PA Independent Enrollment Broker (IEB) telephonically 1-877-550-4227, online https://paieb.com/en/waiver-application, mail application PA Independent Enrollment Broker - Web Referral Form 

3. Functional assessment:

   1. Assessor from IEB will conduct an in-person, comprehensive evaluation to determine if you meet the Nursing Facility Clinically Eligible (NFCE) criteria 

   2. Complete physician certification form: verify need for nursing level facility level of care MA 570 Physician Certification Form

4. Financial Eligibility Review: 

   1. IEB sends application to County Assistance Office to confirm financial eligibility

   2. If you are found ineligible  for medicaid due to income, you may be eligible for Act 150 with a potential co-payment

5. Service Planning and Approval

   1. Work with a service coordinator to develop a personalized care plan that outlines the needed services, such as personal assistance, financial management, or emergency response systems 

   2. Once approved services can begin 

6. Direct Your Care 

   1. As an Act 150 participant, you are responsible for managing your own care, including hiring, training and supervising
